The present petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.38 dated 12.03.2023, registered under Section 22 of NDPS Act, at Police Station Kot Ise Khan, District Moga.

As per custody certificate filed by learned State counsel, the petitioner is behind bars for only 9 months and 2 days, commercial quantity of contraband has been recovered from him and he is involved in 1 more case under the NDPS Act.

Learned counsel for the petitioner prays for withdrawal of the instant petition at this stage.
