(ORAL) Through this petition filed under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to the petitioner in case bearing FIR No.84 dated 14.09.2023 registered under Sections 21(1), 4(1) of the Mines and Minerals (Development and Regulation) Act, 1957 at P.S. Sadar Rupnagar, District Rupnagar, Punjab. 2.

Learned counsel for petitioners submits that petitioner No.2 has unfortunately expired.

Learned State counsel on instructions from ASI Kulwinder Singh submits that in compliance of order dated 27.02.2024, petitioner No.1 has joined the investigation and is no more required for further interrogation.

Having considered the facts and circumstances of the case, order dated 27.02.2024 passed by this Court is made absolute qua petitioner No.1, however, he shall keep on appearing before the Investigating Agency as and when required and shall abide by the conditions as envisaged under Section 438(2) CrPC. As regards petitioner No.2, in view of the submission made by learned counsel for the petitioners, the present petition qua petitioner No.2 has been rendered infructuous.
