MANJARI NEHRU KAUL, J. (ORAL) Mr. Azad Khan, Advocate has put in appearance on behalf of respondents No.7 and 10 and has filed his vakalatnama in Court today, which is taken on record.

At the outset, learned State counsel has informed the Court that as per the averments made by the petitioner himself, there is an FIR registered against him under Section 363 IPC in the State of U.P. wherein the alleged detenue has made a statement in his favour, under Section 164 Cr.P.C. It has also been submitted that the alleged detenue is residing in the State of U.P.

In the above circumstances, no ground is made out to issue a writ in the nature of habeas corpus since the alleged detenue is residing at a place beyond the jurisdiction of this Court. Dismissed.
