On 01.09.2021, the following order was passed:- "The hearing of the case was held through video conferencing on account of restricted functioning of the Courts.
It is admitted position on record that the Block Development and Panchayat Officer, Jagraon, Ludhiana, has not followed the procedure prescribed under Section 216 of the ASHOK KUMAR 2021.09.07 10:30 I attest to the accuracy and integrity of this document
CWP-37291-2019 (O&M) and connected case -2Punjab Panchayati Raj Act, 1994, before ordering recovery from the petitioner. In the reply affidavit, the concerned Block Development and Panchayat Officer has stated that the recovery proceedings are not under the Punjab Panchayati Raj Act, 1994. The State Legislature has enacted an Act while laying down the procedure for recovery of the amount. Keeping in view the aforesaid facts, the Director, Rural Development and Panchayat Department, Punjab, is directed to attend the hearing of the case through video conferencing on the date fixed to explain as to how the officials are proceeding in infringement of the Act.
List on 03.09.2021.
A photocopy of this order be placed on the file of the other connected case."
In deference to the aforesaid order, Sh. Manpreet Singh Chhatwal, Director, Rural Development & Panchayat Deptt., Punjab, has entered appearance and informs the Court that the impugned orders in both the writ petitions stand withdrawn and proceedings in accordance with the provisions of the Punjab Panchayati Raj Act, 1994, shall be initiated. He has also assured the Court that departmental proceedings shall be initiated against the concerned Block Development and Panchayat Officer. Keeping in view the aforesaid facts, the writ petitions are rendered infructuous and are disposed of as such. All the pending miscellaneous application(s), if any, are also disposed of.
