**** HARNARESH SINGH GILL , J. (ORAL) The petitioner seeks regular bail in FIR No. 865 dated 01.12.2015 under Sections 394, 397, 120-B IPC and Section 25 of the Arms Act, 1959 registered at Police Station Sadar Karnal. Learned counsel for the petitioner submits that the petitioner was declared proclaimed offender on 14.7.2019 and was arrested on 27.9.2019 and the co-accused in the FIR in question were acquitted on 27.9.2016. He further submits that no specific role has been attributed to the petitioner and while acquitting the co-accused, the trial Court has observed that entire case of prosecution is based on disclosure statement and coaccused Salim Ali has already been granted regular bail by this Court vide order dated 29.1.2020. Learned counsel also submits that the petitioner has been in custody since 27.9.2019.

Learned State counsel, on instructions from ASI Manjeet Singh, submits that in the present case, supplementary challan has been filed and GURPREET SINGH 2020.02.04 16:15 I attest to the accuracy and authenticity of this document chandigarh charges are yet to be framed.

CRM-M No. 55172 of 2019 -2The petitioner has been in custody since 27.9.2019. Charges are yet to be framed. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
