The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to re-issue his passport.

The petitioner was issued passport on 09.09.2002 which expired on 08.09.2012. The petitioner stayed in Netherland for 13 years where he lost his passport. The petitioner was issued passport on 06.06.2012 which was valid upto 05.06.2014. The petitioner was deported from Netherland on the ground of illegal stay. The petitioner was issued Emergency Certificate on 01.08.2018. The petitioner, since 2019, is staying in India. The petitioner vide application dated 27.07.2021 (Annexure P-3) requested for re-issuance of passport.

Learned counsel for Union of India, who on advance notice is present in Court, submits that application of the petitioner has already been closed and petitioner is at liberty to file a fresh application which would be considered and disposed of in accordance with law. 4.

Faced with this, learned counsel for the petitioner seeks permission to withdraw the instant petition with liberty to file a fresh application seeking passport.

Dismissed as withdrawn with liberty as aforesaid. If the petitioner files a fresh application seeking passport, the same would be considered and disposed of in accordance with law.
