(ORAL) In the present case, the petitioners have approached this Court for the grant of increment on the ground that they have superannuated on 30.06.2013, 30.06.2014 and 30.06.2015 but they have not been given the benefit of increments for the respective years on the ground that they will only become entitled for the increments on 01.07.2013, 01.07.2014 and 01.07.2015 but they retired before the said date.

Counsel for the petiitoners states that once the petiitoners have worked full year, they are entitled for the increment and the same cannot be denied on the ground that they retired on the last date. Counsel for the petitioners further states that for the relief which has been sought in the present writ petition, the petitioners have served respondents with a legal notice on 25.07.2018 (Annexure P-3), NARESH KUMAR 2018.12.19 15:48 I attest to the accuracy and integrity of this document Chandigarh

CWP-32023-2018 -2which is still pending consideration with the respondents and the petitioners will be satisfied, at this stage, in case a time bound direction is given to the respondents to decide the said legal notice. In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioners, the respondents are directed to decide the legal notice dated 25.07.2018 (Annexure P-3) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioners are entitled for any monetary benefit, the same shall also be released to them within a period of next three months.

Present writ petition stands disposed of.
