RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to the petitioner in case FIR No.0600 dated 04.12.2019 registered under Sections 3/13(1) m, 8/13(3) of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015 at Police Station Tauru, District Nuh.

According to prosecution, on 04.12.2019, on the basis of secret information, a raid was conducted at the disclosed place. 130 kgs beef, two knives, one axe and one piece of wood were recovered from the spot. However, petitioner succeeded in fleeing away. Learned counsel for the petitioner inter alia contends that entire story put forth by the prosecution is false inasmuch as it is impossible for a person to escape from 4/5 police officials. -2CRM-M-54683 of 2019 Refuting above submissions, learned State counsel, producing reply by way of affidavit of Anil Kumar, Deputy Superintendent of Police, Nuh, District Nuh, submits that place where the raid was conducted is owned and possessed by petitioner. Statements of Sarpanch and Nambardar (Annexures R-1 to R-3) in this respect have been recorded. In view of above, petitioner does not deserve the concession of anticipatory bail. He is very much required for custodial interrogation. Dismissed.
