Prayer in the third petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in FIR No.150 dated 09.10.2022 registered under Sections 21 and 22 of the NDPS Act, 1985 at Police Station Kot Ise Khan, District Moga.

As per custody certificate dated 12.12.2023 has been filed by learned State counsel, the petitioner is behind bars for only 01 year, 02 months and 02 days. Learned State counsel submits that commercial quantity of contraband was recovered from the petitioner, who was apprehended at the spot. The petitioner is not involved in any other case. The second bail application was withdrawn on 23.08.2023.

In view of the above, learned counsel for the petitioner prays for withdrawal of the present petition, at this stage. 4.

Ordered accordingly.
