(ORAL) Pe oner herein is defendant No.4 in civil suit bearing CIS No.CS-120-2021 tled Harphool Singh vs. Surender Singh and others, pending before learned Civil Judge (Junior Division), Jind. He is aggrieved by the order dated 25.05.2023 (Annexure P-16) passed by the trial Court, whereby his defence along with the defence of defendants No.3 and 5 was struck off. Learned counsel prays for grant of one opportunity to file the wri;en statement. It is further submi;ed that defendants No.3 and 5 had filed a separate revision bearing CR-6024-2023 and that this Court vide order dated 08.11.2023 has already allowed that revision, subject to payment of cost of ₹10,000/- to the plain ff. 2.

Having regard to the aforesaid facts and circumstances and considering that similarly placed defendant No.3 and 5 have already been allowed to file their wri;en statement subject to payment of cost, the present pe on is also accepted. The impugned order dated 25.05.2023 (Annexure P-16) qua defendant No.4 - pe oner is hereby set aside. The trial Court shall allow one opportunity to the pe oner to file his wri;en statement subject to payment of cost of ₹10,000/- payable to the respondent-plain ff by way of demand draB.
