The instant petition has been filed by the petitioner seeking setting aside of order dated 10.4.2017 (Annexure P-1) passed by learned Judicial Magistrate 1st Class, Assandh vide which the petitioner was declared a proclaimed person with respect to FIR No.521, dated 4.9.2015 registered at Police Station Assandh, District Karnal, under Sections 323, 354, 406, 498-a of Indian Penal Code.

The matter basically arises out of a matrimonial dispute leading to initiation of several litigations. On the last date of hearing, both the learned counsel had expressed that there could be some chances of an amicable settlement and PANKAJ KAKKAR 2023.05.05 12:55 I attest to the accuracy and authenticity of this document

Having regard to the fact that the parties have resolved their matrimonial dispute by way of settlement/agreement dated 1.5.2023 and that both the learned counsel do not have any objection for disposal of the instant petition, it will be in the fitness of things that the instant petition be accepted particularly since the matter arises out of a matrimonial discord amongst the parties, which stands resolved.

The instant petition, as such, is allowed and the impugned order dated 10.4.2017 (Annexure P-1) passed by learned Judicial Magistrate 1st Class, Assandh is hereby set aside.
