On the asking of the court, Mr. I.P.S. Doabia, Addl.A.G., Punjab, who is present in court, accepts notice on behalf of the State. At the outset learned State counsel has apprised the court that the nomination papers were rejected by Returning Officer-Harpreet Singh. Election petition preferred by the petitioner is now pending before the SDM-Anand Sagar Sharma, who is vested with the powers of Election Tribunal, who is not the same officer as the Returning Officer. The apprehension of the petitioner is, thus, misplaced.

Faced with this situation, learned counsel for the petitioner submits that he may be allowed to withdraw this petition with liberty to raise his plea before the Election Tribunal.
