Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent - Corporation to shift the name of Late Sh. Rajinder Kumar, Ex-Sewadar from the New Defined Contributory Pension Scheme to the Old Pension Scheme and to pay the arrears of family pension to the petitioner. 2.

Learned counsel for the petitioner submits that for claiming the aforesaid relief, the petitioner has submitted a demand notice dated 12.08.2024 (Annexure P-4) and at this stage, the petitioner would be satisfied, if the said demand notice is decided by passing a speaking order within a time bound frame.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.2 to consider and decide the demand notice dated 12.08.2024 (Annexure P-4), submitted by the petitioner expeditiously, by passing a speaking order, preferably within a period of three months from the date of receipt of certified copy of this order.
