NACT/4243/2023 Ɵtled "M/s AcƟon ConstrucƟons Equipment Limited v/s M/s Shree Hospitals Equipments and another" Seeking quashing of complaint and order of summoning dated 02.12.2023, the accused has come up before this Court under SecƟon 528 BNSS, 2023. 2.

While hearing the maƩer, on a query posed by this Court from counsel for the peƟƟoner, it has been brought to the noƟce of this Court that noƟce of acquisiƟon has already been issued, however the said order has not been challenged. 3.

Since the noƟce of acquisiƟon is final order and a revisional jurisdicƟon would apply and the said order is required to be challenged. 4.

Faced with the situaƟon, counsel for the peƟƟoner wishes to withdraw the present peƟƟon with liberty to take appropriate steps to challenge the noƟce of acquisiƟon order and other preceding orders. Counsel for the peƟƟoner further submits that in case peƟƟoner is granted exempƟon from personal appearance, they will not claim prejudice in this regard in any Court.

Given such assurance, the present peƟƟon is disposed of as withdrawn with the liberty aforesaid. Trial Court to consider the applicaƟon for exempƟon from personal appearance of peƟƟoner, if any filed sympatheƟcally in accordance with law. All pending applicaƟons, if any, stand disposed.
