CRM-M-61389-2023 Instant petition has been filed under Section 438, Cr.P.C., for grant of anticipatory bail in:- FIR No.

Dated Police Station Section(s) 24.10.2023 Hariana, District Hoshiarpur.

21(1) of Mines and Minerals (Development and Regulation) Act, 1957, and Section 379, IPC.

Counsel for the petitioner submits that although petitioner has been convicted for offences under Section 379, IPC, and 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, but he is not involved in the present case, as two tractors and one trolley with illegally mined sand and a motored excavator allegedly belonging to the petitioner, have been recovered from the premises of Surjit Singh. Counsel submits that petitioner has been implicated because of a political vendetta and he is prepared to associate with the investigation.

On asking of the Court, Mr. A.P.S.Tung, DAG, Punjab, accepts notice on behalf of the respondent-State. List on 22.02.2024.

Petitioner is directed to appear before the Investigating Officer on 28.12.2023 at 10.00 A.M. at Police Station Hariana, District Hoshiarpur, and join the investigation and appear as and when called by the Investigating Officer. In the event of arrest, he shall be admitted to interim bail on furnishing personal and surety bonds to the satisfaction of Arresting/Investigating Officer. He shall also abide by the conditions as specified under Section 438 (2) Cr.P.C. "

[2] Today, learned State Counsel, on instructions from HC Anil Kumar, has informed this Court that the petitioner has joined the investigation, in compliance of the order dated 14.12.2023 and is no longer required for further investigation.

[3] In view of the aforesaid, the order dated 14.12.2023, whereby the petitioner was granted interim anticipatory bail, is hereby made absolute. However, he shall continue to join investigation, if and so required by the Investigating Officer.
