(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No. 135 dated 05.05.2015 (Annexure P-1) registered under Section 72 of Information and Technology Act, 2000 at Police Station Civil Line Kaithal, District Kaithal and all subsequent proceedings arising therefrom, on the basis of compromise dated 16.03.2019 (Annexure P-2) and affidavit dated 09.12.2019 (Annexure P-3), effected in between the parties. Pursuant to order dated 06.01.2020 of this Court, the parties appeared before the Judicial Magistrate Ist Class, Kaithal, on 07.02.2020 to get their statements recorded. Learned Judicial Magistrate Ist Class, Kaithal, has submitted his report vide letter No. 141 dated 17.02.2020, duly forwarded by the learned District and Sessions Judge, Kaithal, vide RISHU KATARIA 2020.02.26 16:12 I attest to the accuracy and integrity of this document

According to the report, learned Judicial Magistrate Ist Class, Kaithal, is satisfied that compromise effected between the parties is voluntarily and without any coercion, threat, pressure or undue influence.

In compliance of order dated 06.01.2020, photocopy of receipt dated 10.01.2020 (Mark-A) regarding deposit of costs of `20,000/- has already been placed on record.

Considering the report of Judicial Magistrate Ist Class, Kaithal, dated 17.02.2020 and deposit of costs as well as the fact that the compromise will bring peace and harmony between the parties, aforesaid FIR No. 135 dated 05.05.2015 (Annexure P-1) and all subsequent proceedings arising therefrom, are quashed, qua the petitioner only.

Registry is directed to verify deposit of aforesaid costs, with the concerned quarter.
