The present petition has been filed under Section 439 Cr.P.C. for granting regular bail in case FIR No.244 dated 29.08.2015, under Sections 22, 61, 85 of Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station Nakodar (Sadar), District Jalandhar (Annexure P-1).

After arguing vehemently on the merits of the case, learned counsel for the petitioner has emphasized on the long custody of the petitioner and submits that prosecution is not proceeding with the trial and only 05 witnesses out of 07 witnesses have been examined till date. 3.

Custody certificate filed by learned State counsel is taken on record.

Per contra, learned State counsel submits that the petitioner does not have clean antecedents and, in fact, he is convicted in FIR No.141 Manju 2024.04.18 12:45 I attest to the accuracy and integrity of this document

2024:PHHC:048522 CRM-M-61692-2023 dated 05.10.2016, under the Arms Act vide order dated 12.09.2022 and is in custody on that account also.

Faced with the above, learned counsel for the petitioner does not press the present petition, at this stage, and contains his prayer that since 05 out of 07 witnesses have been examined, the trial be expedited. 6.

In light of the above, the present petition is disposed of, at this stage, without commenting on the merits of the case with a direction to trial Court that it shall make a positive endeavour to complete the trial, which is pending since 2015, preferably within three months from today.
