The petitioner has approached this Court seeking grant of regular bail in respect of a case registered vide FIR No.121 dated 17.8.2019 registered at Police Station City-1, Malerkotla, District Sangrur under Section 379-B of Indian Penal Code.

The FIR was lodged at the instance of Chatar Singh, wherein it has been alleged that on the day of occurrence three boys snatched his mobile phone. 3.

The learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in the present case and that, in any case, since the mobile phone already stands recovered his further detention is not required. He has further submitted that the petitioner, in any case, also deserves the PANKAJ KAKKAR 2020.01.10 17:22 I attest to the accuracy and integrity of this document

Opposing the petition, the learned State counsel has submitted that since the petitioner is involved in two other cases, he does not deserve the concession of bail.

I have considered rival submissions addressed before this Court. Bearing in mind the fact that the petitioner has been behind bars since the last more than four months and that the recovery already stands effected and challan stands presented, further detention of the petitioner will not serve any useful purpose as the conclusion of trial is likely to take some time. 6.

The petition, as such, is accepted and it is ordered that the petitioner be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
