**** JASJIT SINGH BEDI, J. (Oral) On 01.10.2025, the following order was passed:- "Present petition has been filed under Section 528 of BNSS, 2023 for quashing of orders dated 02.01.2017 and 01.02.2017 (Annexure P-5) vide which the petitioner was declared a proclaimed person in case FIR No.0308 dated 03.10.2013 under Sections 323, 506, 494, 120-B IPC at Police Station Nissing Karnal, District Karnal.

Learned counsel for the petitioner inter alia contends that proceedings under Sections 323/494/506 and 120-B IPC had been initiated pursuant to complaint submitted by Meena Devi w/o Sunil arraying the petitioner herein as an accused. She contends that the petitioner was never served in the said proceedings as is evident from the proclamation order as well. It is also contended that the complainant did not support the case of the prosecution resulting in the acquittal of accused Sunil.

Dr. Malvika Singh, DAG, Haryana accepts notice on behalf of respondent-State and prays for time to seek instructions.

In the meanwhile, subject to the petitioner deposting a sum of Rs.5,000/- with the Haryana State Disaster Response Fund, State Bank of India, Account No.39681102475, IFSCSBIN0010603, New Haryana Civil Secretariat Branch, Sector 17, Chandigarh and thereafter appearing before the Illaqa KUSUM 2026.03.18 10:20 I attest to the accuracy and integrity of this document PHHC Chandigarh

CRM-M-55627-2025 Magistrate within a period of two weeks from the date of passing of this order, she shall be released on interim bail subject to her furnishing fresh bail/surety bonds to the satisfaction of the Illaqa Magistrate."

In deference to the aforementioned order, the petitioner has surrendered before the Trial Court and has since been released on interim bail vide order dated 14.10.2025 passed by the Judicial Magistrate Ist Class, Karnal. A copy of the said order is taken on record and marked as Mark 'A'. An amount of Rs.5,000/- stands deposited. In view of the above, no further orders are required to be passed by this Court.

It is expected that the petitioner shall not absent himself from the Trial without sufficient cause.
