**** HARNARESH SINGH GILL , J. (ORAL) The petitioner seeks regular bail in FIR No. 63 dated 10.6.2018 under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Jhabal District Tarn Taran. Learned counsel for the petitioner submits that in the present case, charge was framed on 17.12.2018 but till date no witness has been examined. Learned counsel further submits that as per the zimni order dated 18.12.2019, PWs Constable Inderjit Singh and ASI Paramjit Singh have not appeared despite being served and they were ordered to be summoned through bailable warrants in the sum of Rs. 20,000/- with one surety in the like amount and the case was adjourned to 14.1.2020. On 14.1.2020, the accused was produced from the jail but no witness was present on the said date and the case was adjourned for 29.2.2020. He further submits that the petitioner has been in custody since 10.6.2018. CRM-M No. 55230 of 2019 -2date no prosecution witness has been examined. A perusal of the zimni orders shows that it is the prosecution who has been delaying the trial. The petitioner has been in custody since 10.6.2018. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
