**** HARSIMRAN SINGH SETHI , J. (ORAL) Learned counsel for petitioner states that though the petitioner had joined the respondent-Corporation as a Conductor on 10.04.1962, but as his provident fund was deducted for the first time from 01.04.1963, the service, which he had rendered from 10.04.1962 till 31.03.1963, has not been taken into account as a qualifying service for computing the pensionary benefits.

Further, claim of the petitioner is that his pension has also not been revised keeping in view the order passed by this Court in CWP No.25733 of 2012 titled as 'A.P. Sharma and others Vs. State of Punjab and others', decided on 22.10.2013. The prayer of the petitioner is for recomputing his pension by taking into account the service, which he had rendered from 10.04.1962 to 31.03.1963 for calculating the pensionary benefits and also for giving the benefit of the judgment in A.P. Sharma's case (supra).

CWP-302-2020 -2Learned counsel for the petitioner states that for the relief, which is being claimed in the present writ petition, petitioner has served the respondents with a legal notice dated 07.10.2019 (Annexure P-12), which is still pending consideration with the respondents and the petitioner shall be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 07.10.2019 (Annexure P-12) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
