The petitioner Pawan has approached this Court seeking issuance of a writ in the nature of habeas corpus seeking release of his wife Kirandeep Kaur with whom he had solemnized marriage on 15.7.2019. 3.
Pursuant to interim directions issued on 20.12.2019, the alleged detenue namely Kirandeep Kaur has been produced in the Court, who has been identified by HC Sukhjit Kaur, who is present in Court. Upon being quizzed by this Court, the aforesaid Kirnadeep Kaur stated that she is aged more than 18 years and that she had solemnized marriage with the petitioner and wishes to reside with him and not with her parents. The private respondents i.e. respondents No.4 to 7 are present in person. While respondents No.4 and 5 are parents of Kirandeep Kaur, respondents No.6 and 7 are her relatives.

Faced with the aforestated position, wherein Kirandeep Kaur has stated that she wishes to reside with the petitioner, the private respondents have assured that they shall not take law in their hands and will not cause any harm either to Kirandeep Kaur or to the petitioner.

Kirandeep Kaur would be at liberty to accompany the petitioner right from this Court itself, in case she wishes to.

The petitioner has, however, assured that he shall invest an amount of `1 lakh in FDR in the name of his wife Kirandeep Kaur in some Nationalized Bank within a period of six months from today. 8.
In view of the aforesaid assurance, the petitioner is directed to do accordingly within a period of six months.

No further directions are required to be issued in the facts and circumstances of the case.
