(Oral) On 30.09.2025, the following order was passed:- "The prayer in the present petition under Section 528 of BNSS is for quashing of the order dated 18.07.2025 passed by the Judicial Magistrate Ist Class, Chandigarh in case bearing No.NACT-7537-2023 dated 23.10.2023 titled as 'M/s Adhunik Crop Pvt. Ltd. vs. M/s Mital Pesticides Fatehabad' under Section 138 of the N.I. Act at District Chandigarh, vide which the bail granted to the petitioner has been cancelled and non-bailable warrants have been issued and subsequent proceedings emanating therefrom including order dated 01.09.2025 (Annexure P-2) vide which proclamation has been issued under Section 82 Cr.P.C.

The learned counsel for the petitioner contends that as the petitioner was suffering from acute diarrhea, he was unable to appear on 18.07.2025 because of which the

impugned orders dated 18.07.2025 and 01.09.2025 (Annexures P-1 and P-2 respectively) came to be passed. He states that the petitioner is ready and willing to join the proceedings once again Notice of motion.

Mr. Pawan Kumar Dogra, Addl.P.P., with Ms. Mahima Dogra, Advocate, and Mr. Shobhin Bali, Advocate, appear on behalf of the respondent No.1-U.T., Chandigarh and accept notice.

Adjourned to 10.11.2025.

In the meanwhile, the petitioner is directed to surrender before the Trial Court within a period of one week from today and subject to a deposit of Rs.50,000/- as costs Punjab State Legal Services AuthorityDisaster Relief Fund, Account No.44426937384, IFSC Code:SBIN0014656, State Bank of India, Sector 68, SAS Nagar, he shall be admitted to interim bail to the satisfaction of the Trial Court.

A copy of the receipt depositing a sum of Rs.50,000/- with the aforesaid Centre as well as a copy of the order granting interim bail to the petitioner be produced in the Court on the next date of hearing" In deference to the aforementioned order, the petitioner has surrendered before the Trial Court and has since been released on interim bail vide order dated 04.10.2025 passed by the Duty/Judicial Magistrate Ist Class, Chandigarh. A copy of the said order is taken on record and marked as Mark 'A'. An amount of Rs.50,000/- stands deposited. A copy of the same is taken on record and marked as Mark 'B'. In view of the above, no further orders are required to be

passed by this Court.

It is expected that the petitioner shall not absent himself from the Trial without sufficient cause.
