RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed under Section 438 Cr.P.C. praying for grant of anticipatory bail to the petitioner in case FIR No.379, dated 12.09.2019, under Sections 498-A, 323, 406, 506 IPC, registered at Police Station Azad Nagar, Hisar, District Hisar, Haryana. Vide order dated 20.12.2019, the matter was sent to the Mediation and Conciliation Centre of this Court, with an interim order not to take any coercive action against the petitioner. Thereafter the parties appeared before the Mediation and Conciliation Center. The report of the Mediator, dated 14.01.2022, is also placed on record showing that the parties could not reach at any amicable settlement.

Thereafter, vide order dated 19.01.2022, the petitioner was directed to join the investigation. The petitioner joined the investigation, MEENU 2022.07.22 16:38 I attest to the accuracy and authenticity of this order/judgment

CRM-M-55146-2019 -2however, on the request of learned counsel for both the parties, both the petitioner and the complainant were requested to be present in Court in person.

Today, both are present alongwith their counsel. After interacting with both of them, it is deciphered that the parties cannot settle the dispute amicably. Counsel for the complainant has submitted that there remains some recovery to be effected. However, the same cannot be a ground for rejection of the bail as the matter is to be investigated and thereafter decided by the trial Court on the basis of the evidence to be led before it.

In view of the above, interim order dated 19.01.2022 is made absolute subject to compliance of conditions as envisaged under Section 438(2) Cr.P.C.

Petition stands allowed.
