Lachman Singh v. State Of Punjab

Apprehending his arrest in FIR No.199 dated 31.10.2023,registered for offences punishable under Sections 15, 25, 29 of the NDPS Act, at Police Station Sadar Jagraon, District Ludhiana Rural, the petitioner has preferred this petition under Section 438 Cr.P.C. seeking pre-arrest bail.

Ld. Counsel for the petitioner inter alia submits that the petitioner has been nominated on the basis of disclosure made by coaccused. Earlier also the petitioner was roped-in. However, during interrogation the petitioner was found to be innocent and the cancellation report was prepared qua him.

State Counsel is not in position to dispute the aforesaid factual assertions made by counsel for the petitioner borne out of record.

Adjourned to 30.04.2024.

In the meantime, in the event of arrest, the petitioner shall be released on interim bail subject to his furnishing personal and surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. As and when called, the petitioner shall join the investigation. He shall abide by the conditions enumerated under Section 438(2) of the Cr.P.C.
