(ORAL) This writ petition has been filed by the petitioners alleging illegal mining activities in village Sohati, Tehsil Kharkhoda, District Sonipat and for seeking appropriate directions for proceeding further with the case FIR No. 212 dated 23.06.2019 registered under Sections 379 and 406 of the Indian Penal Code at Police Station Kharkhoda, District Sonipat. Pursuant to the directions issued by this Court on 02.03.2020, status report by way of an affidavit dated 21.03.2022 was filed by the Senior Superintendent of Police, Sonipat. Further, status report by way of an affidavit dated 25.03.2022 was filed by the Deputy Commissioner, Sonipat. Now, the latest status report by way of an additional affidavit dated 22.05.

2022 has been filed by the Deputy Commissioner, Sonipat, wherein it is stated that the Special Investigation Team (SIT) headed by a Deputy Superintendent of Police (HQ), Sonipat, which was constituted on 06.03.2020, has found that some illegal activity had taken place, but at present, no mining activity is going on the Gram Panchayat land at village Sohati, Tehsil Kharkhoda, District Sonipat. It is further stated that the deponent would ensure that no mining work is done on the Gram Panchayat land in future as well. It is informed that FIR No. 212 has been registered under Sections 379, 406 and 409 IPC against the culprits and the SIT has also filed a charge-sheet before the competent Court and the matter is now listed on 06.08.2022 for framing of charges.

In view of the aforesaid latest status report, nothing further is required to be done by this Court in the present writ petition as it is evident that the respondent-authorities have taken adequate steps in the matter. AMODH SHARMA 2022.05.
