Vs The State of Punjab
...Respondent
CORAM:HON'BLE MS. JUSTICE JAISHREE THAKUR
Present:
Mr. Bikramjit Aroura, Advocate for the petitioner.
Mr. Davinder Bir Singh, DAG, Punjab.
-.- JAISHREE THAKUR J. (ORAL) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.196 dated 13.09.2019 under Sections 307, 379-B, 353, 295-A, 186, 332, 333, 506, 148, 149 IPC registered at Police Station, Lopoke, Amritsar Rural and subsequently added Sections 341, 354, 120-B IPC and Section 67-A of Information and Technology Act, 2000.
Learned counsel for the petitioner contends that he has been falsely implicated in the instant FIR as the same is an outcome of political vendetta. The petitioner was taken into custody in the aforesaid FIR on 16.10.2019. It is also contended that no further investigation is required in the matter as the challan has already been presented by the police. Moreover, the co-accused Dilbag Singh, Sarmail Singh, Jatinder Singh and Shamsher Singh have also been granted a concession of regular bail by this Court vide order dated 16.12.2019 and therefore, the petitioner is also entitled to be enlarged on bail.

CRM-M No.55236 of 2019 -2Per contra, learned counsel appearing on behalf of the respondent-State opposes the bail application, while contending that the offences alleged against the petitioner are serious in nature, therefore, the petitioner is not entitled to concession of regular bail. I have heard learned counsel for the parties. Since the trial court is likely to take some time and in view of the fact that no further investigation is required and the co-accused have already been granted regular bail by this Court and therefore, no useful purpose would be served in keeping the petitioner behind the bars, the instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal bond and surety bond to the satisfaction of concerned trial Court/Duty Magistrate.
