As observed in the previous order, despite service, the respondent did not make appearance on that day. Even today, none has appeared on behalf of the respondent. As such, the respondent is proceeded against ex-parte.

Applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act, filed by respondent-husband, bearing No.DMC-553-2025, titled 'Gurpreet Singh vs. Komal Malhotra', pending in the Family Court Patiala, and she seeks transfer of the same to the Court of competent jurisdiction at Ludhiana. TA-1268-2025 -2taken place on 26.06.2020 and one daughter born from the said wedlock, is in the care and custody of the applicant. On account of matrimonial dispute, the parties are residing separate. The applicant has also filed the petition under Section 13 of the Hindu Marriage Act, which is pending in the Courts at Ludhiana and the same is at appearance stage. The distance between the two places is stated to be 93 kms. Considering the aforesaid circumstances, and more particularly, considering the applicant not having any source of earning and taking care of the minor child and above all, the respondent not having come forward to resist the application, the transfer application, as such, is hereby allowed and the petition under Section 9 of the Hindu Marriage Act, filed by respondent-husband, bearing No.

DMC-553-2025, titled 'Gurpreet Singh vs. Komal Malhotra', stands transferred from the Family Court, Patiala, to the Court of competent jurisdiction at Ludhiana. The requisite record of the aforesaid case be sent by the Family Court, Patiala, to the District and Sessions Judge, Ludhiana.

Learned District and Sessions Judge, Ludhiana, shall assign the said petition to the Family Court, Ludhiana. Even, the parties are directed to appear before the Family Court, Ludhiana, within a period of one month from today onwards.
