The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of order dated 24.04.2025 (Annexure P-14) whereby respondent No.4 has been transferred in violation of office order dated 13.01.2025.

As per petition, the respondent No.4-Ruchira Khullar, Principal, Pt. Jawahar Lal Nehru College, Faridabad was placed under suspension. A statement of charges was issued on 25.09.2024. Respondent No.4 was reinstated vide order dated 24.12.2024. She filed reply in departmental inquiry. District Higher Education Officer vide order dated 13.03.2025 recommended constitution of High-Level Committee to inquire about the matter. Despite said order, respondent No.4 was brought back to Pt. Jawahar Lal Nehru College, Faridabad. She was transferred from said college on

CWP No. 29314-2025(O&M) -222.08.2024. The petitioner claims that transfer of respondent No.4 to Pt. Jawahar Lal Nehru College, Faridabad is bad and contrary to spirit of office order dated 13.03.2025.

As per affidavit dated 13.04.2026 of Deputy Commissioner, Faridabad, the matter was inquired by High Level Committee. The Committee submitted its report on 10.12.2025. It was found that there was sale of scrap and other items lying within the college premises. A sum of Rs.12,000/- was fetched from the sale of said material. A sum of Rs. 3,05,750/- was collected from students as fine and a sum of Rs.75,000/- was received as donation from M/s Victora Auto Private Limited for a cultural program. Respondent No.4 has deposited afore-stated amounts besides a sum of Rs.7,010/-. There was delay of approximately five months in depositing the amount collected as fine otherwise there was no embezzlement of funds. Allegations levelled in the complaint do not appear to be substantiated.

Learned State counsel submits that by order dated 25.03.2026, Dr. Ruchira Khullar, Principal, Government College, Faridabad has been placed under suspension.

From the perusal of record, it is evident that there are allegations against respondent No. 4 that she collected fine from students but did not deposit. As per reply filed by Deputy Commissioner, Faridabad, there was delay on the part of respondent No. 4 in depositing fine collected from students. The delay was of five months. The allegation of embezzlement of funds is not substantiated. Respondent No. 4 has already been placed under suspension.

In the backdrop, no further order is warranted. 7.
