(Oral) At the outset, learned counsel for the petitioners seeks to withdraw the petition in hand with liberty to take all the pleas (as available in law) during the course of appropriate stage of trial. He has, however, submitted that personal presence of petitioners No. 1, 2 & 4 be exempted. The main case is directed to be dismissed as withdrawn with liberty as aforesaid.

However; keeping in view the advance age of petitioners No. 1 and 2 & petitioner No. 4 being a lady aged 34 year, who is stated to be married nanad-sister-in-law; personal presence of the these three petitioners i.e. petitioners No. 1, 2 & 4 before the trial Court is exempted subject to the following conditions :- (i) They will be represented by a counsel;

(ii) They will not delay/stall the proceedings of the trial Court;

CRM-M-59214 of 2024 (iv) They will have no objection if the prosecution evidence is recorded in their absence but in presence of their counsel;

(v) They will appear before the trial Court as and when required by the trial Court and any other condition which the trial Court may impose.

The petitioners shall file affidavits before the concerned trial Court stipulating above conditions.
