The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondent No. 2 to re-issue his passport.

The petitioner was issued passport on 05.11.2007 which expired on 04.11.2017. The petitioner vide application dated 30.05.2023 applied for re-issuance of passport. The petitioner is involved in two FIRs i.e. FIR No. 21 dated 20.01.2010, under Sections 498-A, 420 of IPC, registered at Police Station, Barnala and FIR No. 143 dated 01.12.2021, under Sections 279, 337, 338, 427 of IPC, registered at Police Station, City Rampura Phull, Tehsil Rampura Phull, District Bathinda. As per petitioner, he has already PARAMJIT KAUR SAINI 2023.12.12 17:31 I attest to the accuracy and authenticity of this order/judgment

CWP No.27776 of 2023 -2- 2023:PHHC:158613 been acquitted in FIR No. 21 dated 20.01.2010 and till date challan has not been presented in FIR No. 143 dated 01.12.2021. 3.

Learned State counsel, who on advance notice is present in Court, does not dispute the aforesaid factual position. 4.

Learned counsel for Union of India, who on advance notice is present in Court, submits that petitioner was directed to appear before passport authority on 19.10.2023, however, he chose not to appear and has filed the present petition before this Court. 5.

The petitioner is directed to appear before passport authority on 27.12.2023 alongwith documents relating to afore-mentioned FIRs. On doing so, the passport authority would pass an appropriate order within six weeks from 27.12.2023.

The petition stands disposed of accordingly.
