Through the instant petition, prayer is made for issuance of directions upon the official respondents concerned to conclude the further investigation in FIR No.03 dated 08.01.2011, under Sections 420, 120-B of the IPC, registered at P.S. Kapurthala City, District Kapurthala, which has been pending for almost a decade, and thereupon, present the Final Report.

The learned State counsel has filed a status report, on affidavit of Vatsala Gupta, IPS, Senior Superintendent of Police, District Kapurthala, which is taken on record. This status report makes revelations that, after completion of investigation in the FIR (supra), a Cancellation Report has already been filed before the learned Magistrate concerned, on 02.02.2024. However, owing to non-appearance of the complainant, who has not caused appearance despite him being called twice, the said Cancellation Report is pending adjudication.

In view of what has been averred in the status report (supra), the grievance of the petitioner does not survive any longer, as it stands already redressed. Consequently, the instant petition is dismissed, as having been rendered infructuous.

Today, the Senior Superintendent of Police, District Kapurthala has recorded her personal appearance before this Court, in compliance of the directions issued by this Court on 08.01.2024. What had constrained this Court to direct the officer concerned to cause her personal appearance today, was that, on the last date of hearing, i.e. 08.01.2024, her subordinate official had failed to purvey any instructions or assistance to the learned State counsel, which consequently acted as a handicap for the latter to respond to the queries posed by this Court. 5.
The officer concerned has tendered apology before this Court qua the conduct of her subordinate official, and, has assured this Court that she will ensure her house/department being set in order. She has further assured this Court that, henceforth, any official/officer who may attend this Court for lending assistance to the learned State counsel, will come fully prepared and equipped with the requisite information. Consequently, the further appearance of the officer concerned is dispensed with.
