In light of the aforesaid facts, Coordinate Bench of this Court stayed arrest of the present petitioner subject to joining of investigation. 4.

Today, counsel appearing on behalf of the petitioner apprised the Court that in compliance of the aforesaid order, the petitioner has joined the investigation with the police.

State counsel on instructions from ASI Nirmal Singh has not refuted the aforesaid assertions made by the counsel for the petitioner and further, made statement that the petitioner is no longer required by the police for purpose of further investigation in this case. 6.

Disclosure statement, if any, suffered by co-accused against the present petitioner will be tested during trial with regard to its veracity and relevance. In the given circumstances, no purpose is going to be served if the petitioner is subjected to custodial interrogation at this point of time.
