The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking direction to the respondents to revoke suspension order dated 29.06.2020 and reinstate him like similarly situated police officials.

Learned counsel for the petitioner submits that an FIR No.192 dated 14.10.2015 was registered against the petitioner as well as other police officials. Thereafter, another FIR No.130 dated 21.10.2015 was registered against the petitioner and other police officials with respect to same incident which was foundation of FIR No.192 dated 14.10.2015. 3rd FIR No.129 dated 07.08.2018 was registered against the petitioner and other police officials. The petitioner has been found innocent in the said FIR. The investigation of FIR No.130 dated 21.10.2015 is still pending and police report in FIR No.192 dated 14.10.2015 stands presented. CWP-27661-2023 -22023:PHHC:157454 co-accused have been reinstated and this Court in the case of Paramjit Singh, who was posted as Superintendent of Police, has directed the respondents to reinstate him.
He further submits that, at this stage, grievance of the petitioner would be redressed, if respondents are directed to decide his representation dated 23.01.2023 in the light of order passed by this Court in CWP No.11824 of 2022 titled as "Paramjit Singh vs. State of Punjab and another".

Faced with this, learned State counsel submits that the competent authority would decide representation of the petitioner in the light of afore-cited judgment and applicable rules within two months from today.

In the wake of statement of learned counsel for the parties, the present petition stands disposed of. If the petitioner has not been paid subsistence allowance, claim for the same be considered and released, at the earliest.
