The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to the respondents to pay interest on delayed payment of pensionary/retiral benefits.

Mr. Deepak Goyal, Advocate submits that the petitioner retired on 31.03.2019 as Inspector. During his service, FIR No.134 at Police Station Sector 3, Chandigarh was registered against him. He was discharged by trial Court vide order dated 12.02.2014, thus, on the date of retirement, no criminal proceedings were pending against him. He was subjected to departmental punishment of forfeiture of 05 years' service on permanent basis. CWP-31126-2024 ultimately set aside by learned Additional District Judge, Chandigarh vide judgment dated 06.07.2019. The respondent was duty bound to release petitioner's retiral dues within two months from the date of retirement, however, he was paid Rs.7,23,872/- towards retiral dues on 21.12.2022. The said payment was made without interest. He has filed representation dated 23.09.2024 but to no avail. Mr. Goyal submits that grievance of the petitioner, at this stage, would be redressed if respondents are directed to consider his claim qua interest on delayed payment of retiral dues. 3.

Mr. Aman Dhir, DAG, Punjab, accepts notice on behalf of respondent-State and waives service and submits that the competent authority would consider petitioner's claim for interest and pass an appropriate order within three months from today. 5.

Learned counsel for the petitioner agrees to aforesaid arrangement.

In the wake of statement of Mr. Dhir, the present petition stands disposed of.
