Applicant-wife has filed the present application for seeking transfer of the petition under Section 13(1)(ia) of the Hindu Marriage Act, filed by respondent-husband, bearing No.HMA-767-2024, titled 'Ankur vs. Sheetal', pending in the Family Court, Jhajjar and she seeks transfer of the same to the Court of competent jurisdiction at Charkhi Dadri. In pursuance of the notice issued, the respondent made appearance through counsel.
At this stage, counsel for the respondent submits that he does not want to file reply and also, that the respondent has no objection, if the transfer application is accepted.

TA-1288-2025 -2Keeping in view the statement so made by counsel for the respondent, also it is necessary to pin point that one son born from the wedlock of the parties, who is about 3 years old, is in the care and custody of the applicant. Three other litigation, arising from this broken marriage, are already pending in the Courts at Charkhi Dadri and the respondent is pursuing all the aforesaid cases, more particularly, the criminal case, wherein, he is required to make appearance, on each and every date of hearing.
In view of the statement made and the fact of other litigation already pending in the Courts at Charkhi Dadri, the transfer application, as such, is hereby allowed and the petition under Section 13(1)(ia) of the Hindu Marriage Act, filed by respondent-husband, bearing No.HMA-7672024, titled 'Ankur vs. Sheetal', stands transferred from the Family Court, Jhajjar to the Court of competent jurisdiction at Charkhi Dadri. The requisite record of the aforesaid case be sent by the Family Court, Jhajjar to the District and Sessions Judge, Charkhi Dadri. Learned District and Sessions Judge, Charkhi Dadri shall assign the said petition to the Family Court, Charkhi Dadri. Even, the parties are directed to appear before the Family Court, Charkhi Dadri, within a period of one month from today onwards.
