The learned counsel for the petitioner has very fairly submitted that, since the issue pertaining to the petitioner becoming declared to be tried as an adult has attained finality upto this Court, therefore, they have assailed the said observations, through instituting an appropriate motion before the Hon'ble Supreme Court. Consequently, he seeks leave to withdraw the instant petition, however, with liberty to re-access this Court, on the same cause of action, in case they succeed in their attempt before the Hon'ble Supreme Court.

Considering the innocuous and bona fide request of the learned counsel for the petitioner, leave is granted to withdraw the instant petition. 3.

Consequently, the instant petition is dismissed as withdrawn, however, with liberty (supra).
