(Oral) At this stage, counsel for respondents No.1 and 2 has given a statement that the said respondents have no objection, if the transfer application is accepted the claim petition i.e. MACP/513/2020, titled 'Mona Aggarwal and another Vs. Nitish Sanmotra and others', is transferred from Chandigarh to the Court of competent jurisdiction at Bathinda. Perusal of the paperbook reveals that on account of death of Akashdeep, son of Mohinder Singh, his widow-Satinder Kaur and others have filed the claim petition i.e. MACP/167/2020, copy whereof is Annexure A-1, in the Courts at Bathinda. On query, it is disclosed that the said claim Sonu 2025.12.10 16:26 I attest to the accuracy and authenticity of this document
TA-1606-2023 petition is pending for respondent evidence. There is another claim petition i.e. MACP/513/2020, filed at the instance of respondents No.1 and 2, relating to death of aforesaid Akashdeep, in a motor vehicular accident and the same is pending in the Courts at Chandigarh, at the stage of filing of written statement. In the given circumstances, two claim petitions are pending, qua death of Akashdeep.
With a purpose to avoid passing of the conflicting Awards and also in view of the statement given by the counsel for respondents No.1 and 2, the transfer application is allowed and the claim petition i.e. MACP/513/2020, titled 'Mona Aggarwal and another Vs. Nitish Sanmotra and others', stands transferred from the Motor Accident Claims Tribunal, Chandigarh, to the Court of competent jurisdiction at Bathinda. The requisite record of the aforesaid case be sent by learned Tribunal at Chandigarh, to the District and Sessions Judge, Bathinda. Learned District and Sessions Judge, Bathinda, shall assign the said petition to the Tribunal, where the claim petition i.e. MACP/167/2020, between the parties, is already pending. Even, the parties are directed to appear before the concerned Tribunal, within a period of one month from today onwards.
