**** HARSIMRAN SINGH SETHI , J. (ORAL) Petitioners i.e. husband and daughter of deceased Prabhjot Kaur, respectively, have filed the present writ petition seeking the ex-gratia amount as per the policy (Annexure P-1). Counsel for the petitioners states that deceased Prabhjot Kaur was appointed as a Social Study Mistress in the year 2013 and her services were regularized w.e.f. 15.01.2016 and hence, she was a regular employee of the respondents/department. Unfortunately, Prabhjot Kaur died in a road accident on 23.05.2016 leaving behind the petitioners. Counsel for the petitioners further states that as per the ex-gratia policy, issued by the State of Punjab, the petitioners are entitled for the ex-gratia amount as Prabhjot Kaur died while in service. CWP-31268-2018 -2Counsel for the petitioners further states that for the relief which has been sought in the present writ petition, the petitioners have submitted a representation dated 16.07.2016 (Annexure P-6) and thereafter, served respondents with a legal notice on 22.09.2018 (Annexure P-7), which are still pending consideration with the respondents and the petitioners will be satisfied, at this stage, in case a time bound direction is given to the respondents to decide the legal notice dated 22.09.2018 (Annexure P-7).

In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioners, the respondents are directed to decide the legal notice dated 22.09.2018 (Annexure P-7) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioners are entitled for any monetary benefit, the same shall also be released to them within a period of next three months.

Present writ petition stands disposed of.
