**** HARSIMRAN SINGH SETHI , J. (ORAL) Though, in the present writ petition the petitioner is claiming the benefit of 2nd ACP, but at the time of hearing of the case, learned counsel for the petitioner states that as per the instructions received from the petitioner he is not pressing the same.
Learned counsel for the petitioner states that only the relief of the full pension, keeping in view the order passed by the Delhi High Court in CWP No.4862 of 1999 titled as 'Om Pal Singh Vs. Union of India and others', decided on 25.04.2000, is being pressed by the petitioner as he is similarly situated as Sh. Om Pal Singh and is also entitled for the grant of full pension on the basis of the said judgment. Learned counsel for the petitioner further states that petitioner has already submitted to the respondents a representation dated NARESH KUMAR 2020.01.15 13:55 I attest to the accuracy and integrity of this document Chandigarh
CWP-331-2020 -205.02.2019 (Annexure P-6) in this regard, which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said representation.
Notice of motion.
Keeping in view the advance copy supplied to the respondents, Ms. Saigeeta Srivastava, Advocate, accepts notice on behalf of the respondents and she states that the respondents have no objection in case the prayer of the petitioner for deciding the representation dated 05.02.2019 (Annexure P-6) in a time bound manner is accepted. In view of the above, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the representation dated 05.02.2019 (Annexure P-6) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
