Advocate General, Punjab. **** SHEEL NAGU, CHIEF JUSTICE (Oral) The petitioner, who is in custody since 15.08.2024, has filed this first application for regular bail in respect of the offences punishable under Sections 307 and 304 (Section 317(2) added later on)of the Bharatiya Nyaya Sanhita-2023 in FIR No. 101 dated 15.08.2024 registered at Police Station Sarabha Nagar, District Police Commissionerate, Ludhiana.

It is alleged that one sharp edged weapon i.e. sickle has been recovered from the petitioner.

Though there is a delay of seven days in lodging of the FIR but keeping in view the nature of the offences, it would be appropriate that the complainant is allowed to be examined before the trial Court before the request for bail is considered.

With the aforesaid liberty along with the fact that the petitioner may also revisit the Court in case the trial is further delayed, this Court for the time being, dismissed the present petition for grant of bail.
