Petitioner has preferred this second petition seeking pre-arrest bail in a case registered against him vide FIR No. 17 dated 16.01.2015 under sections 406/420 IPC at police station Model Town Hoshiarpur. Learned counsel for the petitioner submits that petitioner was found innocent during the enquiry conducted by DSP Chhabewal. He is, thus, entitled to concession of pre-arrest bail. Plea has been opposed by learned State counsel. She submits that complainant has been duped of huge amount and allegations against the petitioner are specific. Heard.
FIR was registered on the basis of complaint moved by Balbir Singh alleging that he had paid sum of `19,00,000/- in September 2012 and `7,00,000/- in March 2013 alongwith original passport and some other documents of his son namely Amarjit Singh to Harmeet Singh (petitioner herein) and Amandeep Singh on the pretext of sending him to Canada. However, petitioner neither fulfilled the promise nor returned the amount. CRM-M-355-2020 Economic Offences Branch, Hoshiarpur, instant FIR under sections 406, 420 IPC was registered against the petitioner and Amandeep Singh. It appears that similar bail application was moved by the petitioner before this court which was dismissed on April 07, 2015. He has preferred the second petition without pointing out any change of circumstance. FIR was registered way back in the year in January, 2015 and petitioner has been absconding from justice since then. He instead of submitting to the process of law is filing one petition after the another. In my considered view, petition is without any merit. Same is hereby dismissed.
