H. S. Madaan, J. (Oral) Learned State counsel, on instructions from ASI Kulwant Singh, states that the petitioner has since joined the investigation and he is not required for custodial interrogation by the Investigating Agency.

Learned counsel for the petitioner contends that though as per the prosecution story, the petitioner was having a datar at the time of incident, but no sharp edged injury on the person of injured is there.

Complainant Harjit Singh, as identified by Mr. Sandeep Sharma, Advocate, is present. He admits that the matter has been compromised between the parties as such he does not oppose the BANITA CHUGH 2020.03.16 09:46 I am the author of this document

CRM-M-55569 of 2019 -2present petition. In these circumstances, the interim bail granted to the petitioner vide order dated 26.12.2019 is made absolute, subject to fulfillment of following conditions:- i) that the petitioner shall appear in the Court on each and every date of hearing.

ii)that the petitioner shall not give any threat or intimidation to the prosecution witnesses.

iii)that the petitioner shall not leave India without the prior permission of the Court.

iv)that the petitioner shall surrender his passport before the Investigating Officer and if he is not having passport then he shall file an affidavit in that regard.

In case the petitioner violates any term and condition on which the bail has been granted to him, the prosecution would be entitled to apply for cancellation of bail.

The petition in that way is allowed.
