Seeking directions to take legal action against respondent No.1 for committing perjury in Arbitration Application No.264 of 2023 titled as Kamal Kishore Aggarwal vs. Rajesh Kumar Aggarwal & ors.

At the outset, counsel for the petitioner submits that cause of action would actually arise after the disposal of the arbitration application, as such he wants to withdraw the present petition with clarification that time for which the present petition was pending may not be counted for the purpose of limitation, if he files a fresh petition. 3.

Given above, present petition is disposed of as withdrawn with clarification that in case the petitioner files a fresh petition after decision of arbitration application, the time for which the present petition was pending shall not be counted for the purpose of limitation. It is further clarified that filing and disposal of the present petition shall not come in petitioner's way if petitioner files a fresh petition. Pending applications, if any, stand disposed of.
