MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking issuance of directions to the official respondents to arrest or to take appropriate action as per law against private respondent No.5, who was declared proclaimed person vide order dated 06.07.2023 by learned JMIC, Ludhiana, in Complaint No.COMA/6641/2022 titled as 'Surinder Kumar Versus Mohd. Shakir Khan'.

Learned counsel for the petitioner submits that the police, for reasons best known, has failed to take steps to arrest respondent No.5 (accused) in the above-mentioned complaint case, even through he is openly and unabashedly moving around and residing at his known place of residence. Learned counsel has submitted that the petitioner has moved an application dated 06.10.2023 (Annexure P-6) in the said regard before Commissioner of Police, Ludhiana, that respondent No.5, who was declared a proclaimed person on 06.07.2023 and qua whom an FIR under Section 174-A of the IPC has been registered, is available at his place of work i.e. M/s Seema Garmets, Office/Shop No.106/263, PUNEET SACHDEVA 2025.01.09 12:42 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-57816-2024 -2Hamraj Road, Sangeet Talkies, Kanpur (U.P.), however still no steps have been taken by the police to go to the said place and arrest him. 3.

After arguing for some time, learned counsel for the petitioner submits that the petitioner would be satisfied if directions are issued to respondent No.2-Commissioner of Police, Ludhiana, to look into his application (Annexure P-6) and take appropriate steps at the earliest.

On the asking of the Court, Mr. H.S. Deol, Senior Deputy Advocate General, Punjab, accepts notice on behalf of the State. 6.

In view of the restricted prayer of the learned counsel for the petitioner, the instant petition is disposed of with directions to respondent No.2-Commissioner of Police, Ludhiana, to look into the application dated 06.10.2023 (Annexure P-6) of the petitioner and take appropriate steps, if required, in accordance with law.
