After arguing vehemently on the merits of the case and raising the issue of limitation as well as the documents appended with the complaint to demonstrate that the complaint is not maintainable, learned counsel for the petitioner has very fairly sought permission to withdraw the present petition, however, has prayed that the personal appearance of the petitioner be exempted as he is 64 year old man. 2.

Without commenting on the merits of the case, the present petition stands dismissed as withdrawn and the petitioner is directed to put in appearance before the trial Court on 14.12.2023 and subsequent thereto as and when the petitioner files an application for exemption from personal appearance, the same shall be considered leniently.
