SUVIR SEHGAL, J. (Oral) The Court has been convened through video conferencing due to Covid-19 pandemic.

Through the instant petition, the petitioners seek anticipatory bail in case FIR No.0167 dated 01.11.2019 registered under Sections 323, 324, 341, 382, 506, 148, 149 of Indian Penal Code, 1860 at Police Station Kamboj, District Amritsar Rural.

On 31.12.2019, following order was passed:- "Insofar as Satinderpal Singh-petitioner No.3 is concerned, he has already been arrested on 28.12.2019. The anticipatory bail on his behalf is dismissed.

{2} Insofar as petitioners No.1, 2 and 4 are concerned, learned counsel for the petitioners has placed reliance upon the order dated 03.12.2019 passed by this Court in CRM-M-51330 of 2019 titled as Chanchal Singh and another versus State of Punjab. He has submitted that infact it is a case of cross fight and Chanchal Singh (father of petitioner No.1) had also suffered injuries.

Learned counsel for the complainant has also appeared and opposed the prayer for anticipatory bail on the ground that some recoveries are yet to be made from the petitioners. Meanwhile, the petitioners No.1, 2 and 4 shall join the investigation and would come present as and when called for and in the event of arrest, the petitioners No.1, 2 and 4 shall be admitted to interim bail on their furnishing personal and surety bonds to the satisfaction of Arresting Investigating Officer. The petitioners No.1, 2 and 4 shall also abide by the conditions as specified under Section 438(2) Cr.P.C. Adjourned to 10.01.2020.

To be heard along with CRM-M-51330 of 2019."

Interim order passed in CRM-M-51330 of 2019 has been made absolute.

Counsel for the petitioners submits that petitioner No.1Sangram Singh, has expired and the petition qua him has become

Ordered accordingly.

Learned State counsel, on instructions from ASI Surjit Singh submits that petitioners No.2 and 4 have joined investigation and are no longer required for custodial interrogation. He has further instructions to submit that petitioners No.2 and 4 are not involved in any other criminal case.

In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 31.12.2019 granting interim bail to petitioners No.2 and 4 is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
