RAJESH BHARDWAJ, J. (ORAL) Matter has been taken up through video conferencing via Webex facility in the light of the Pandemic Covid-19 situation and as per instructions.

The present petition has been filed under Section 438 Cr.P.C for grant of anticipatory bail to the petitioner in FIR No.376 dated 12.10.2019, under Sections 323, 406, 494, 498-A, 506, 34 IPC registered at Police Station Pinjore, District Panchkula.

This case was referred to the Mediation and Conciliation Centre of this Court. A report of the Mediator is received wherein it has been found mentioned that no amicable settlement could be arrived at between the parties. Both the counsel also endorse the same. It has been contended by learned counsel for the petitioner that in pursuance of the above order, the petitioner had joined the investigation and fully cooperated and thus, the interim order may kindly be made absolute.

Learned State counsel on instruction from HC Kavita Sharma endorsed the same and submitted that petitioner is no more required for further investigation.

Learned counsel for the complainant, however, opposes the prayer made and submits that recovery is yet to be effected. In view of the above, the order dated 30.12.2019 is made absolute and the petition stands allowed.
