JASGURPREET SINGH PURI , J. (ORAL ) The present petition has been filed under Section 438 of the Code of Criminal Procedure (for short 'the Cr.P.C.)' praying for grant of anticipatory bail in FIR No.0061 dated 22.09.2019, under Sections 323, 324, 452, 326, 307, 506 and 34 IPC, registered at Police Station Kahnuwan, District Gurdaspur.

Learned counsel for the petitioner has, inter alia, argued that in the present case a fight had taken place between the complainant and the petitioner. CRM-M-55673-2019 (O&M) other persons whereas Annexure P2, is the complaint which was filed before the learned Judicial Magistrate by the brother of the petitioner in which there are allegations of grievous hurt. He has further submitted vide Annexure P5, co-accused namely Usha Rani and Balwinder Singh, had filed a petition for the grant of anticipatory bail which has been allowed on 26.11.2019.

On 30.12.2019, this Court had issued notice of motion to the State and interim protection was granted to the petitioner subject to his joining investigation and complying with the provisions contained in Section 438 (2) Cr.P.C.

Today, learned State counsel, on instructions from ASI Kulwinder Singh, states that the petitioner has joined investigation and the recovery has already been effected. He further, on specific instructions, states that the petitioner has fully cooperated with the investigation process and is no longer required for further custodial interrogation. In view of above stand taken by the learned State counsel, the present petition is allowed. Interim order dated December 30, 2019, is hereby made absolute.
