Prayer in the instant petition is for issuance of appropriate directions to the respondents to register the FIR against the accused persons for the commission of cognizable offence in the light of judgment of Hon'ble Supreme Court reported as Lalita Kumari vs. State of U.P, 2014 (2) SCC 1 and/or to transfer the investigation to some other agency or to crime Branch. 2.

On the last date of hearing i.e 22.12.2023, respondent-UT Chandigarh was put on notice.

At the time of hearing today, learned counsel for the petitioner submits that the petitioner would be satisfied, in case, appropriate direction is issued to the official respondents to look into the complaint dated 22.07.2023 and decide the same, in the light of Lalita Kumari's case (supra). In the wake of the limited prayer of the petitioner, the respondent No.2 i.e. Senior Superintendent of Police, Chandigarh is directed to look into the grievance of the petitioner and take appropriate action, if any required, under the provisions of law. However, if respondent No.2 does not find the commission of any cognizable offence as alleged or any substance in the allegations levelled in the complaint dated 22.07.2023, then the petitioner shall be duly informed as per the parameters laid down by the Supreme Court in Lalita Kumari v. Government of Uttar Pradesh & Ors. 2013 (4) RCR (Criminal) 979. 5.
